Why the Truth in Justice campaign?

***Petition return-by date is near - please send your petitions ASAP to M. Cotter, 10 Victoria St Preston 3072***

The adversary system we inherited from another country has numerous mechanisms which conceal or defeat the truth, and procedures which unnecessarily prolong civil and criminal actions.

Results: more than half the guilty escape justice; up to 5% of people in Australian prisons are innocent; civil hearings can take months.

In properly-run truth-seeking systems, as in France and Germany, 95% of guilty accused are convicted; the innocent are rarely charged; most civil hearings take less than a day.

Change to a truth-seeking system will thus increase justice and reduce costs and taxes.

 Hence...

The Petition

TO THE HONOURABLE SPEAKER AND MEMBERS OF THE HOUSE OF REPRESENTATIVES

We, the undersigned, petition the legislature to begin the process of changing to a truth-seeking legal system. Change is essential because the adversary system which lawyers contrived to impose upon Britain and its colonies, including Australia, is unfair to the community.

As Evan Whitton notes in OUR CORRUPT LEGAL SYSTEM: Why Everyone Is a Victim (Except Rich Criminals):

·    The adversary system operates on the basis that truth does not matter; it is the only system which suppresses evidence.

·    Lawyers trained in sophistry, i.e. the art of lying, are allowed to control evidence and spin the process out.

·    Judges are former lawyers, with no training as judges.

The investigative system used in Europe and other countries is more just because judges trained separately from lawyers search for the truth, and costs less because they have no motive to prolong the process. Thus:

Investigative system

Adversary system

Seeks truth

Yes

No

Conceals evidence

No

Yes

In charge of evidence

Trained judges

Lawyers

Length of civil hearings

Usually about a day

Weeks, months, years

Conviction rates

95%

Under 50%

Innocent in prison

Rare

1% - 5%

Lawyers are 0.2% of the population. Victims of their anti-truth system include victims of crime, taxpayers, litigants, and people in medicine, business, industry, police, and the media. We thus believe that the vast majority of voters will support changing to a truth-seeking system, and therefore ask the House to implement such change
